1. Who We Are

figment (“we”, “us”, “our”) is an AI-powered content intelligence platform operated by figment, headquartered at Jl. Hang Jebat I no.11, Jakarta, Indonesia. figment intelligence is accessible at intelligence.byfigment.ai.

By creating an account and using figment intelligence, you agree to be bound by these Terms & Conditions. If you do not agree, do not use the platform.

2. Eligibility

To use figment intelligence, you must:

• Be at least 18 years of age
• Have a valid Instagram or TikTok account connected to a brand or business you represent
• Have the legal authority to enter into binding agreements on behalf of yourself or your business
• Not be prohibited from using the service under applicable Indonesian law

3. Account Registration

3.1 You must register for an account to access the platform. You agree to provide accurate and complete information during registration and to keep your account information up to date.

3.2 You are responsible for maintaining the confidentiality of your login credentials. You are fully responsible for all activity that occurs under your account.

3.3 You must notify us immediately at hello@byfigment.ai if you suspect any unauthorised use of your account.

3.4 We reserve the right to suspend or terminate your account if we determine that you have violated these Terms & Conditions.

4. Subscription Plans and Payment

4.1 Available Plans

figment intelligence offers the following subscription tiers:

4.2 Billing

• Plus subscriptions are billed on a monthly recurring basis, charged at the beginning of each billing cycle.
• Payment is processed securely through Midtrans, our authorised payment gateway partner.
• Accepted payment methods include credit card, debit card, bank transfer, QRIS, and supported e-wallets, as made available through Midtrans.
• All prices are stated in Indonesian Rupiah (IDR) and are inclusive of applicable taxes unless otherwise stated.

4.3 Auto-Renewal

Your Plus subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. By subscribing, you authorise figment to charge your payment method on a recurring monthly basis until you cancel.

4.4 Failed Payments

If a payment fails, we will notify you by email. For recurring card and GoPay payments, we may automatically re-attempt the charge over several days. You will have a grace period of 7 days from the renewal date, during which your Plus access continues, to update your payment information. If payment is not received within this period, your account will be downgraded to the Free plan until payment is resolved.

4.5 Refund Policy

All subscription payments are non-refundable. If you cancel your Plus subscription, you will retain access to Plus features until the end of your current billing period. No partial refunds will be issued for unused days within a billing cycle.

As a limited exception, if the platform is completely unavailable for more than seven (7) consecutive business daysdue solely to figment’s own technical failure, you may request compensation for the affected period in the form of service credits or an equivalent extension of your subscription. This does not apply to downtime caused by third-party services, your own configuration, or events outside figment’s reasonable control (see Section 12, Force Majeure).

4.6 Price Changes

We reserve the right to change subscription pricing. We will provide at least 30 days’ written notice via email before any price change takes effect. Continued use of the platform after the effective date constitutes acceptance of the new pricing.

5. Cancellation

5.1 You may cancel your Plus subscription at any time through your account settings or by contacting us at hello@byfigment.ai.

5.2 Cancellation takes effect at the end of the current billing cycle. You will not be charged for subsequent cycles.

5.3 Upon cancellation, your account will revert to the Free plan. Your account data will be retained for 90 days, after which it may be deleted.

6. Acceptable Use

You agree to use figment intelligence only for lawful purposes and in accordance with these Terms. You must not:

• Use the platform to collect or scrape data for purposes other than your own brand and content strategy
• Resell, sublicense, or redistribute any data, reports, or content plans generated by the platform
• Attempt to reverse-engineer, copy, or replicate the platform’s algorithms or methodology
• Use the platform in any way that could damage, disable, or impair its operation
• Misrepresent figment’s outputs as your own proprietary research or intelligence product
• Use the platform to engage in any activity that violates Indonesian law or the rights of third parties

We reserve the right to suspend or terminate access for any user who violates this section.

7. Intellectual Property

7.1 figment owns all rights, title, and interest in the platform, including its algorithms, user interface, branding, and underlying methodology. Nothing in these Terms transfers any intellectual property rights to you.

7.2 You retain ownership of your brand data and Instagram or TikTok account information. Content plans and reports generated by the platform are delivered to you for your own use.

7.3 By connecting your Instagram or TikTok account to figment intelligence, you grant us a limited, non-exclusive licence to access and analyse your publicly available Instagram or TikTok data solely for the purpose of delivering the service to you.

8. Third-Party Services

figment intelligence integrates with and relies on the following third-party services to deliver its features:

• Midtrans — payment processing (subject to Midtrans Terms of Service)
• Apify — public Instagram and TikTok data collection
• Anthropic — AI-powered analysis and content generation
• Google — account authentication (login with Google)

We are not responsible for the availability, accuracy, or conduct of these third-party services. Your use of these services is subject to their respective terms and privacy policies.

9. Disclaimers and Limitation of Liability

9.1 figment intelligence is provided “as is” and “as available”. We do not guarantee that the platform will be error-free, uninterrupted, or that the content plans and recommendations generated will result in any specific content performance outcome.

9.2 The intelligence outputs, content plans, and recommendations provided by the platform are advisory in nature. They are based on publicly available data and AI analysis. figment makes no warranty as to their accuracy, completeness, or fitness for your specific business needs.

9.3 To the maximum extent permitted by applicable law, figment’s total liability to you for any claim arising out of or relating to these Terms or your use of the platform shall not exceed the total amount paid by you to figment in the 30 days prior to the event giving rise to the claim.

9.4 figment shall not be liable for any indirect, incidental, special, or consequential damages, including loss of revenue, loss of data, or loss of business opportunity.

10. Governing Law and Dispute Resolution

10.1 These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of Indonesia.

10.2 Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation between the parties.

10.3 If resolution cannot be reached, disputes shall be submitted to the exclusive jurisdiction of the District Court of South Jakarta (Pengadilan Negeri Jakarta Selatan), Indonesia.

11. AI Disclaimer and User Responsibility

11.1 All content, recommendations, and outputs generated by the platform’s AI are for informational and suggestive purposes only. They do not constitute professional financial, legal, or business advice.

11.2 figment does not guarantee any specific business results, profits, or successes. You acknowledge and agree that, subject to the limitation of liability in Section 9, figment is not liable for any financial losses, material damages, or missed business targets resulting from your reliance on or implementation of the AI-generated content.

11.3 You are solely responsible for reviewing, verifying, and approving any content before publishing or distributing it. Once content is shared, published, or used by you, the entire responsibility and legal liability for that content rest with you.

11.4 You agree not to use the platform to generate or publish content that violates any applicable laws, including but not limited to the Indonesian Electronic Information and Transactions Law (UU ITE). figment shall not be held liable for any unlawful content published by users, and you agree to fully indemnify figment against any legal claims arising from your violations.

12. Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is caused by events beyond its reasonable control, including but not limited to natural disasters, wars, pandemics, or mass system or network failures.

13. Restrictions on AI Model Training

You are strictly prohibited from copying, extracting, or using any outputs or content generated by the platform to train, develop, or improve any artificial intelligence models or machine learning systems owned by competitors.

14. Prohibition on Sensitive Data Inputs

You must not input any confidential corporate data (such as internal financial reports) or sensitive personal data of employees or other third parties into the platform’s AI prompts or input fields. You assume all financial and legal risks for any unauthorised disclosure of such data.

15. Changes to These Terms

We may update these Terms & Conditions from time to time. When we do, we will notify you via email or an in-app notification at least 14 days before the changes take effect. Your continued use of the platform after the effective date constitutes your acceptance of the updated Terms.
